A PROCLAMATION.

BALDWIN OF BEWDLEY,
| Governor.



WHEREAS under section 3 of
the Cotton Protection Ordinance
(1922 (No. 7/1922), as amended by the
Cotton Protection Amendment Ordi-
nance, 1926 (No. 5 of 1926), it 1s pro-
vided that the Governor-in-Council
may from time to time by proclama-
tion published in the Gazette declare
any period of each year to be a close
season for cotton and for such other
plants as may be specified in any
such proclamation either for the whole
Presidency or for such area or areas
therecf as may be specified in such
proclamation: Oo

NOW, THEREFORE, I, OLIVER
RIDSPALE. the Earl Baldwin of
Bewdley, Governor and Commander
in Chief in and over the Colony of
the Leeward Islands and Vice Admiral
of the same, with the advice of the
Executive Council of the Presidency
of Antigua, do, by this my proclama-
tion declare that the period from the
1st day of June, 1950, to the 31st day
of August, 1950, inclusive, shall be
a close season within the meaning of
the said Ordinance for the whole
Presidency of Antigua:

ANDI do hereby order all occu-
piers of land, in pursuance of the said
Ordinance, completely to uproot and
burn all cotton and okra plants and
all or any portion of the same grow-
ing or remaining on any such land
oceupied by them before the first day
of the said close season:

AND I do further declare that any

- person who sows or plants or causes

to be sown or planted any cotton or
okra in any part of the said Presiden-
cy during the said close season shall
be guilty of an offence under the said
Ordinance. |

GIVEN at the Government House,
Antigua, this 2nd day of May,
1950, in the fourteenth year of
His Majesty’s reign. :

Method of Selection of Dele-
gates to the West Indian Con-
ference.

The Caribbean Commission Agree-
ment lays it down that delegates to
the West Indian Conference shall be
appointed for each territory in accord-
ance with its constitutional procedure.
Hitherto, the arrangement has been
that of the two delegates from each of
the British Colonies concerned, one is
an unofficial chosen by the local Legis-
lature (in the case of the Leeward
Islands by the General Legislative
Council), and the other an official
nominated by the Governor.

To make it possible for the Legisla-
ture in each Colony to determine the
representation of the Colony at this
Conference, it has been suggested that
the present method of appointment

-ghould be modified by leaving it to

the discretion of the local Legislatures
to decide whether there should be one
or two unofficials.

The suggestion has been accepted
by West Indian Government and,
with the concurrence of the Secretary
of State, is being adopted for the next
session of the West Indian Conference
in 1950 and for succeeding sessions.

1. Short. Title. This Order may be cited as the.
Trading with the Enemy (Authorisation) (Japan) Order,
1950. | : |

_ 2 Authority to Trade. Notwithstanding any-
thing contained in regulation 2 of the Defence (Trading with

the Enemy) Regulations, 1939, any person, unless the

Governor otherwise directs, may trade except as provided in —
_ paragraphs 4 and 5 hereof with any person to whom this

Order applies.

3. Transfer of Annuities, &c. (1) The transfer
by or on behalf of any person within the description contained
in paragraph 6 of this Order of any annuities, stocks, shares,
bonds, debentures or debenture stock registered or inscribed
in any register, branch register or other book kept in the

Colony which, on or after the date of this Order, come into
the ‘ownership of any such person as aforesaid, is hereby
sanctioned. - |

(2) The Governor hereby consents to the allotment or
transfer of any securities as defined in sub-paragraph (1) of
this paragraph to or for. the benefit of any individual
who isan enemy subject resident in Japan or any body’ of
persons constituted or incorporated in or under the laws of

Japan, :

4, Limitation of Licence. As regards any prop-
erty situate in the Colony belonging to or held or managed at —
the date of this Order on behalf of any person to whom —
this Order applies and as regards any property arising
presently or at any future time out of such property this
Licence shall not, except in the case of anything done under
an authority, given generally or specially by, or by any person
authorised in that behalf by, the Governor, extend to or
authorise any trade in respect thereof. ~ : CO

5. Effect on Prior Contract. This Licence shall
not, except in the case of anything done under an authority,
given. generally or specially by, or by any person authorised,
in that behalf by the Governor extend to or authorise any
trade in respect of any contract entered into before the date of

this Order. |

6. Application. This Order applies—
(a) to any Government, public or other authority in
Japan, — | oO _ |
(b) to any individual resident in Japan,
-. (c) as respects any business carried on in Japan, to
any individual or body of persons (whether corporate
or unincorporate) carrying on that business. |

7. Interpretation. (1) For the purposes of this
Order— | Os oo

any estate or interest in real or personal property,
any negotiable instrument, debt or other chose in
action, and any other right or interest whether in
possession or not, and ge |

govereignty on the 7th December, 1941. |

(2) The Interpretation Act (Cap. 103)shall apply to the
interpretation of this Order as it applies to the interpretation of

8 Revocation. The Trading with the Enemy
(Authorisation) (Japan) Order, 1947, (S. BR. & O. 1947 No. 24)

is hereby revoked.

(This Note is not part of the Order, but is intended to indicate its
general purport.)

Trade with persons in Japan has hitherto been permitted to
a limited extent only. This Order authorises trade with such persons
without restriction except in so far as concerns Japanese property and
property rights in the Colony at the date of this Order and property
(which includes income) arising now or in future from such property.
It further permits the transfer or allotment of securities, as defined, to
individuals and bodies of persons in Japan. It revokes a previous
Order which authorised trade to a limited degree.

1. Short Title. This Order may be cited as the Trading .

(Japan) Order, 1990.

29, Transfer of Negotiable Instruments, &c, The
Governor hereby sanctions— | |

(a) any assigment of a chose in action which, on or
after the date of this Order, comes inte the ownership of
‘an authority or a person to whom this Order applies,

(6) any transfer of a negotiable instrument issued on |
or after that date, and : )

(c) any transfer of any security transferable by
delivery, not being a bond, a coupon ora negotiable instru-'
ment, which on or after that date conres inte the ownership
of an authority or person to whom this Order applies,

being an assignment or transfer made on or after the date of
this Order within the authority given by the Trading with the
Enemy (Authorisation) (Japan) Order, 1950, (8.8. & O. 1950 _
No. 8); by or on behalf of an authority or a person to whom

this Order applies. — |
3. Application. This Order shall apply—

(a) to any Government, public or other authority in

Japan,

1. Short Title. This Order may. be cited as the
Trading with the Enemy (Custodian) (Amendment) (Japan)
Order, 1950. |

2. Removal of Control over Money or Prop-
erty. Paragraplis 2, 5 and 6 of the Trading with the Enemy
-(Oustodian) Order, 1940 (requiring payment of certain monies
to the Custodian and im posing resirictions and requirements
in regard to certain proper ty i in the Colony), shall’ not apply
to—

(a) any money which would bat for the operation of
paragraph 2 of the Trading with the Enemy (Custodian)
Order, 1940, become payable te or for the benefit of any
person within the deseri iption contained in paragraph 3 of.

‘this Order by reason of any trade authorised by paragraph

2 of the Trading with the Enemy (Authorisation) (J apan)

Order, 1950 (S. R. & O, 1950 No. 8);

(6) any property which on or after the date of this
Order comes into the ownership of any person within
the description contained 3 in paragraph 3, of this Order by
reason of any such trade as atoresaid including any money —
derived therefrom; |

(ce) any money or property to which the above
mentioned paragraphs would apply only because any such



‘person as aforesaid became resident or commenced or
recoramenced to carry on business in Japan on or after
the 15th day of August, 194°,

3. Applic: ation. This Order a nplies—

(a) to any Government, public or other authority in

Japan,
(b) to any individual resident in Japan,

(c) as ‘respects any business camtied on.in Japan, to
any individual or body of persons (vhetner corporate or

4. Tnterpestation. (1): for the purposes of this

A PROCLAMATION.

BALDWIN OF BEWDLEY,
| Governor.



WHEREAS under section 3 of
the Cotton Protection Ordinance
(1922 (No. 7/1922), as amended by the
Cotton Protection Amendment Ordi-
nance, 1926 (No. 5 of 1926), it 1s pro-
vided that the Governor-in-Council
may from time to time by proclama-
tion published in the Gazette declare
any period of each year to be a close
season for cotton and for such other
plants as may be specified in any
such proclamation either for the whole
Presidency or for such area or areas
therecf as may be specified in such
proclamation: Oo

NOW, THEREFORE, I, OLIVER
RIDSPALE. the Earl Baldwin of
Bewdley, Governor and Commander
in Chief in and over the Colony of
the Leeward Islands and Vice Admiral
of the same, with the advice of the
Executive Council of the Presidency
of Antigua, do, by this my proclama-
tion declare that the period from the
1st day of June, 1950, to the 31st day
of August, 1950, inclusive, shall be
a close season within the meaning of
the said Ordinance for the whole
Presidency of Antigua:

ANDI do hereby order all occu-
piers of land, in pursuance of the said
Ordinance, completely to uproot and
burn all cotton and okra plants and
all or any portion of the same grow-
ing or remaining on any such land
oceupied by them before the first day
of the said close season:

AND I do further declare that any

- person who sows or plants or causes

to be sown or planted any cotton or
okra in any part of the said Presiden-
cy during the said close season shall
be guilty of an offence under the said
Ordinance. |

GIVEN at the Government House,
Antigua, this 2nd day of May,
1950, in the fourteenth year of
His Majesty’s reign. :

Method of Selection of Dele-
gates to the West Indian Con-
ference.

The Caribbean Commission Agree-
ment lays it down that delegates to
the West Indian Conference shall be
appointed for each territory in accord-
ance with its constitutional procedure.
Hitherto, the arrangement has been
that of the two delegates from each of
the British Colonies concerned, one is
an unofficial chosen by the local Legis-
lature (in the case of the Leeward
Islands by the General Legislative
Council), and the other an official
nominated by the Governor.

To make it possible for the Legisla-
ture in each Colony to determine the
representation of the Colony at this
Conference, it has been suggested that
the present method of appointment

-ghould be modified by leaving it to

the discretion of the local Legislatures
to decide whether there should be one
or two unofficials.

The suggestion has been accepted
by West Indian Government and,
with the concurrence of the Secretary
of State, is being adopted for the next
session of the West Indian Conference
in 1950 and for succeeding sessions.

1. Short. Title. This Order may be cited as the.
Trading with the Enemy (Authorisation) (Japan) Order,
1950. | : |

_ 2 Authority to Trade. Notwithstanding any-
thing contained in regulation 2 of the Defence (Trading with

the Enemy) Regulations, 1939, any person, unless the

Governor otherwise directs, may trade except as provided in —
_ paragraphs 4 and 5 hereof with any person to whom this

Order applies.

3. Transfer of Annuities, &c. (1) The transfer
by or on behalf of any person within the description contained
in paragraph 6 of this Order of any annuities, stocks, shares,
bonds, debentures or debenture stock registered or inscribed
in any register, branch register or other book kept in the

Colony which, on or after the date of this Order, come into
the ‘ownership of any such person as aforesaid, is hereby
sanctioned. - |

(2) The Governor hereby consents to the allotment or
transfer of any securities as defined in sub-paragraph (1) of
this paragraph to or for. the benefit of any individual
who isan enemy subject resident in Japan or any body’ of
persons constituted or incorporated in or under the laws of

Japan, :

4, Limitation of Licence. As regards any prop-
erty situate in the Colony belonging to or held or managed at —
the date of this Order on behalf of any person to whom —
this Order applies and as regards any property arising
presently or at any future time out of such property this
Licence shall not, except in the case of anything done under
an authority, given generally or specially by, or by any person
authorised in that behalf by, the Governor, extend to or
authorise any trade in respect thereof. ~ : CO

5. Effect on Prior Contract. This Licence shall
not, except in the case of anything done under an authority,
given. generally or specially by, or by any person authorised,
in that behalf by the Governor extend to or authorise any
trade in respect of any contract entered into before the date of

this Order. |

6. Application. This Order applies—
(a) to any Government, public or other authority in
Japan, — | oO _ |
(b) to any individual resident in Japan,
-. (c) as respects any business carried on in Japan, to
any individual or body of persons (whether corporate
or unincorporate) carrying on that business. |

7. Interpretation. (1) For the purposes of this

any estate or interest in real or personal property,
any negotiable instrument, debt or other chose in
action, and any other right or interest whether in
possession or not, and ge |

(2) The Interpretation Act (Cap. 103)shall apply to the
interpretation of this Order as it applies to the interpretation of

8 Revocation. The Trading with the Enemy
(Authorisation) (Japan) Order, 1947, (S. BR. & O. 1947 No. 24)

is hereby revoked.

general purport.)

Trade with persons in Japan has hitherto been permitted to
a limited extent only. This Order authorises trade with such persons
without restriction except in so far as concerns Japanese property and
property rights in the Colony at the date of this Order and property
(which includes income) arising now or in future from such property.
It further permits the transfer or allotment of securities, as defined, to
individuals and bodies of persons in Japan. It revokes a previous
Order which authorised trade to a limited degree.

1. Short Title. This Order may be cited as the Trading .
with the Enemy (Transfer of Negotiable Instruments, etc.)
(Japan) Order, 1990.

29, Transfer of Negotiable Instruments, &c, The
Governor hereby sanctions— | |

(a) any assigment of a chose in action which, on or
after the date of this Order, comes inte the ownership of
‘an authority or a person to whom this Order applies,

(6) any transfer of a negotiable instrument issued on |
or after that date, and : )

(c) any transfer of any security transferable by
delivery, not being a bond, a coupon ora negotiable instru-'
ment, which on or after that date conres inte the ownership
of an authority or person to whom this Order applies,

being an assignment or transfer made on or after the date of
this Order within the authority given by the Trading with the
Enemy (Authorisation) (Japan) Order, 1950, (8.8. & O. 1950 _
No. 8); by or on behalf of an authority or a person to whom

this Order applies. — |
3. Application. This Order shall apply—

(a) to any Government, public or other authority in

Japan,

1. Short Title. This Order may. be cited as the
Trading with the Enemy (Custodian) (Amendment) (Japan)
Order, 1950. |

2. Removal of Control over Money or Prop-
erty. Paragraplis 2, 5 and 6 of the Trading with the Enemy
-(Oustodian) Order, 1940 (requiring payment of certain monies
to the Custodian and im posing resirictions and requirements
in regard to certain proper ty i in the Colony), shall’ not apply
to—

(a) any money which would bat for the operation of
paragraph 2 of the Trading with the Enemy (Custodian)
Order, 1940, become payable te or for the benefit of any
person within the deseri iption contained in paragraph 3 of.

‘this Order by reason of any trade authorised by paragraph

2 of the Trading with the Enemy (Authorisation) (J apan)

Order, 1950 (S. R. & O, 1950 No. 8);

(6) any property which on or after the date of this
Order comes into the ownership of any person within
the description contained 3 in paragraph 3, of this Order by
reason of any such trade as atoresaid including any money —
derived therefrom; |

(ce) any money or property to which the above
mentioned paragraphs would apply only because any such
‘person as aforesaid became resident or commenced or
recoramenced to carry on business in Japan on or after
the 15th day of August, 194°,

3. Applic: ation. This Order a nplies—

(a) to any Government, public or other authority in

Japan,
(b) to any individual resident in Japan,

(c) as ‘respects any business camtied on.in Japan, to
any individual or body of persons (vhetner corporate or
unincor porate) earrving on that busi siness | |

4. Tnterpestation. (1): for the purposes of this
